Probate
When someone passes on it can be a very difficult time for the people they left behind both emotionally and for what they should do next. At Brett Holt Solicitors our expert Probate Solicitors are here to help guide you through the process.
If the deceased left a Will then they will have named executors. The executors are responsible for administering their Estate. They must identify the assets that were held, pay any debts and any taxes that are due, and distribute the remaining funds in accordance with the Will.
In order for the executors to carry out their duties they must first obtain the Grant of Probate. We can help you obtain the Grant of Probate and then administer the estate. This may may include:
Investigating and valuing the estate
Filling out inheritance tax returns and paying any tax due
Applying for a Grant of Probate
Collecting the estate funds
Paying any debts of the estate
Selling or transferring ownership of property
Distributing funds and assets according to the Will
Managing any Trusts in the Will.
If the deceased did not leave a Will their estate is dealt with under the Rules of Intestacy. We can advise on this and obtain the appropriate Grant of Letters of Administration.
